Ministry of National Defense Announces Legislation of Act on Abolition of Garrison Decree


On July 4th, the Ministry of National Defense announced the legislation of an act abolishing the garrison decree. The garrison decree was first issued on May 27, 1950 in order to maintain military order and discipline and protect military facilities. However, the ministry decided to legislate an act abolishing the garrison decree based on its judgement that the decree has low effectiveness it has not been enforced in the last thirty years and the lack of an applicable superordinate law raises potential constitutional issues. “We have decided to abolish the garrison decree because there is no reason to maintain it as a presidential decree. The purpose for which it was established can be served by other laws currently in force, and public order can be maintained with the police force,” a ministry official said.
